Terms and conditions for membership at Art Nordic Online Studios
These terms and conditions (“Terms”) govern the relationship between artists (“the Artist”) and Art Nordic (“Art Nordic”), which operates the website www.art-nordic.dk (the “Website”), and set out the terms and conditions under which the Artist may have a profile on the Website and use Art Nordic’s services.
1. profile and fees
1.1 The Artist may create a profile on the Website by paying a fixed monthly or annual fee as specified on the Website. The artist can cancel their profile with one month’s notice and no payment will be refunded for the previous or remaining period.
1.2 The Artist is responsible for updating their profile and replacing any sold works with new information and images. Art Nordic assumes no responsibility for updating the Artist’s profile.
2. Marketing and Use of Material
2.1 The Artist accepts that when uploading images, text and other material to the Website, the Artist automatically grants Art Nordic permission to use this material for marketing purposes in connection with the Website and Art Nordic’s services.
3. Sale of Works
3.1 The Artist may choose to let Art Nordic handle the sale of his/her works on the Website. Art Nordic takes the following commission for the sale of the Artist’s works:
- 20% commission for the sale of works with a value below 1,350 EUR.
- 15% commission for the sale of works with a value between 1,320 EUR and 2,700 EUR.
- 10% commission for the sale of works worth more than 2,700 EUR.
3.2 The Artist is responsible for shipping the painting with the chosen shipping service in case of sale. Art Nordic’s insurance does not cover the works during shipping.
3.3 Art Nordic will issue an invoice on behalf of the Artist and prepare a receipt for the commission paid. Art Nordic will pay the amount paid for the work 14 days after the buyer has confirmed receipt of the work. During this period, the buyer has the right to return the work. Art Nordic will retain the amount payable as commission to the Artist upon payment.
4. VAT and Tax
4.1 It is the Artist’s responsibility to handle any VAT payments and tax obligations in accordance with applicable legislation. Art Nordic deducts Art Nordic’s commission plus 25% VAT (VAT as a trading platform) from the total sales amount.
5. Disclaimer of liability
5.1 Art Nordic accepts no liability for any loss, damage or costs that the Artist may incur as a result of the Artist’s use of the Website or Art Nordic’s services.
6. Changes to the Terms
6.1 Art Nordic reserves the right to change these Terms with reasonable notice to the Artist. It is the Artist’s responsibility to stay updated on any changes to the Terms.
7. Applicable Law and Dispute Resolution
7.1 These Terms are governed by Danish law and any disputes between the Artist and Art Nordic shall be resolved by negotiations between the parties. If a dispute cannot be resolved through negotiations, it must be settled by the Danish courts.
By creating a profile on the Website and using Art Nordic’s services, the Artist accepts these Terms in their entirety.
8. personal data and privacy policy
8.1 Art Nordic complies with European data protection and privacy legislation. By creating a profile on the Website and using Art Nordic’s services, the Artist accepts Art Nordic’s Privacy Policy, which can be found on the Website and describes how personal data is processed, stored and protected.
8.2 The Artist accepts that Art Nordic may collect and process personal data necessary to provide the services on the Website, including but not limited to name, contact information and payment information. Art Nordic will only use personal data in accordance with applicable legislation and the Privacy Policy.
8.3 The Artist is responsible for keeping their login information and passwords to their profile confidential and must notify Art Nordic immediately in case of suspected unauthorized access to their profile.
8.4 The Artist has the right to request access to, rectification, erasure or restriction of personal data relating to the Artist, as well as the right to data portability in accordance with applicable law. The artist can contact Art Nordic to exercise these rights.
8.5 The Artist agrees that Art Nordic may use technical and organizational security measures to protect personal data against unauthorized access and use, but Art Nordic assumes no liability for loss of data or security breaches unless caused by gross negligence or intentional action on the part of Art Nordic.
